Terms of Service

1. Who we are

Modisign, at modisign.app, is operated by Viacheslav Sierbov, an individual based in Ukraine (“Modisign”, “we”, “us”). By using the website you agree to these terms. If you do not agree, please do not use it.

2. The service

Modisign is a web library of short motion-graphics elements for videos, such as hook titles and subscribe or follow call-to-actions. You pick a template, adjust it in the editor, and download it as a video clip. The clip is rendered by your own browser on your own device.

• Free templates. Templates marked Free download as they are. You choose the background and the format. No account and no payment are needed.
• Pro. A paid monthly subscription that lets you customize every template (text, look and colors), download the result, and reopen your past clips from your account. Pro is not on sale yet. The price is shown in the pricing section.

We may add, change or retire templates and features over time.

3. Accounts

Free templates need no account. An account is needed for Pro, and you create one by signing in with Google; we do not offer passwords. You are responsible for what happens under your account and for keeping your Google account secure. One account is for one person; do not share it.

You must be at least 16 years old, and old enough to enter into a contract where you live, to create an account or subscribe.

To delete your account and its data, email support@modisign.app. How we handle personal data is described in the Privacy Policy.

4. Acceptable use

You agree not to:

• use the service for anything unlawful, or put text into a clip that is unlawful or infringes someone else’s rights;
• get around the limits of the free templates or of Pro, or use someone else’s account;
• download templates or clips in bulk with scripts, scrapers or other automated tools;
• copy, decompile or extract the templates, their code or their designs, other than the clips the service gives you;
• interfere with the website, probe it for weaknesses, or overload it.

5. What you may do with your clips

For every clip you download, free or Pro, we give you a worldwide, non-exclusive, perpetual licence to use it in your own videos and in videos you make for your clients, including commercial and monetized videos, on any platform, without crediting Modisign. This licence continues after a Pro subscription ends for the clips you downloaded while it was active.

You may not:

• sell, sublicense or redistribute the templates or the clips on their own, for example as stock footage, template packs or overlays;
• use the templates or clips to build or fill a competing library, template product or generator;
• claim the template designs as your own work or register them as trademarks.

6. Ownership

The templates, their designs, animation and code, the website and the Modisign name belong to us or our licensors. Apart from the licence in section 5, these terms give you no rights in them.

The text you type into a template stays yours. You are responsible for it and for having the right to use it. For Pro accounts we store it only as part of your clip history, so you can open a clip again.

Some templates imitate the look of other platforms or show their names. Those names and marks belong to their owners, and using them in your videos is subject to those platforms’ own rules.

7. Payments, billing and cancellation

Pro is not on sale yet, and nothing on the website can charge you today. This section applies from the day Pro opens.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

That means you buy Pro from Paddle, under Paddle’s buyer terms, in addition to these terms. Paddle takes the payment, adds any sales tax or VAT that applies where you live, and sends your receipts and invoices. We never see or store your card details.

• Pro is billed monthly in advance, at the price shown at checkout, and renews automatically each month until you cancel.
• You can cancel at any time through the link in your Paddle receipt or by emailing support@modisign.app. Pro stays active until the end of the month you have paid for, and you are not charged again.
• If a renewal payment fails, Pro may be paused or ended until payment succeeds.
• If we change the price, we will tell you by email before the change applies to your next renewal, so you can cancel first.

8. Refunds

You can get a full refund of any Pro payment within 30 days of that payment. The details are in the Refund Policy, which is part of these terms.

9. Availability and warranty

We work to keep Modisign running and the clips looking right, but the service is provided “as is” and “as available”. We do not promise that it will be uninterrupted or error-free, that every template will stay available, or that rendering will work in every browser or on every device. Clips are rendered on your device, so speed and results depend on it.

Nothing in these terms removes rights that the law gives you as a consumer and that cannot be excluded by contract.

10. Limit of liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for lost profits, revenue, data or goodwill, arising from your use of the service. Our total liability to you for all claims is limited to the amount you paid for Pro in the 12 months before the event that gave rise to the claim.

These limits do not apply to liability that cannot be limited by law, such as for fraud, or for death or personal injury caused by negligence.

11. Termination

You can stop using Modisign at any time and ask us to delete your account. We may suspend or close an account that seriously or repeatedly breaks these terms. If we close a paid account for a reason other than a breach, we will refund the unused part of the current month. Sections 5, 6, 9, 10 and 13 continue to apply after these terms end.

12. Changes to these terms

We may update these terms. The effective date at the top shows the current version. If a change materially affects Pro subscribers, we will email them before it takes effect. Continuing to use the service after the effective date means you accept the updated terms.

13. Governing law

These terms are governed by the laws of Ukraine, and its courts have jurisdiction over disputes. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and may also bring a claim in its courts.
